That the governing body, having received recommendation from the planning commission, and further having found that it would be in the best interests of the city, does hereby require that any mobile home which is occupied or inhabited by any person as a dwelling, office, or commercial space, within the city, shall be secured to the ground by tie downs and ground anchors of a type which have been approved by the secretary of administration pursuant to K.S.A. 75-1229, unless such mobile home is secured to the ground on a permanent foundation. Any mobile home which is not secured to a permanent foundation shall be placed upon piers in the manner prescribed by K.S.A. 75-1226 through 75-1234. A copy of the current statutes shall be maintained in the official files of the city clerk.

Any person, firm or corporation violating any provision of this article shall be fined not less than $5 nor more than $500 for each offense, and a separate offense shall be deemed committed during or on any day which a violation occurs or continues.

Any violation of this article is declared to be a nuisance. In addition to any other relief provided by this article, the city attorney may apply to a court of competent jurisdiction for an injunction to prohibit the continuation of any violation of this article. Such application for relief may include seeking a temporary restraining order, temporary injunction, and permanent injunction.

That should at any time K.S.A. 75-1226 through 75-1234 be repealed by the Kansas legislature, such provisions shall remain in effect pursuant to this article until such time as the city shall adopt the same or additional regulations.
