AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF MEDICINE LODGE, KANSAS, (HEREINAFTER REFERRED TO AS “CITY”) AUTHORIZING THE MAYOR AND CITY STAFF TO EXECUTE AND AMEND THE AGREEMENT BETWEEN THE CITY AND NISLY BOTHER, INC, AS APPROVED ON JANUARY 15, 2018.

WHEREAS,          that Nisly Brothers, Inc., provides Refuse and Recyclable Collection Services for the City of Medicine Lodge under an Agreement, approved by the City Council at the January 15, 2018, Council Meeting by Ordinance No. 887; and

WHEREAS,          that said Agreement allows for annual rate adjustments, based on the Consumer Price Index (CPI), commencing on January 1, 2020, and each successive year thereafter; and

WHEREAS,          that Nisly Brothers Requests a 2.5-percent adjustment based upon the CPI for service in 2021.

WHEREAS,          that the said rate adjustment to Agreement with Nisly Brothers, Inc., was submitted to the City Council for approval at the December 6, 2021, Council Meeting.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MEDICINE LODGE KANSAS, AS FOLLOWS:

SECTION 1:          That the City Council of the City of Medicine Lodge, Kansas, (hereinafter referred to as “City”) hereby authorizes the Mayor and City Staff to execute all necessary documents to amend the Franchise Agreement between the City and Nisly Brother Inc. Said Rate Amendment is hereby attached and incorporated herewith and marked “Exhibit A.”
